| 摘 要： | 本文从最高额保证的特点、最高额保证的担保责任范围、最高额保证期间和最高额保证的保证人单方终止权等四个方面，对《担保法》规定的最高额保证进行了理论上的探讨。本文的核心在于对最高额保证与普通保证的区别、最高额保证的责任范围、最高额保证合同期间与保证期间的区别和保证人单方终止最高保证合同的要件等在民商法学界有争议的问题和理论进行整理和批判，以期完善最高额保证的理论研究，并对《担保法》关于最高额保证方面的立法完善产生影响。 |
