| 摘 要： | 近年来不断涌现的学生状告高校诉讼案件反映出高校学生管理规范所存在的缺陷：高校学生管理规范的内容与法律法规相抵触、管理规范制定的程序缺失、学生的合法权益救济途径不畅是高校学生管理规范失范的具体表现.实现高校学生管理规范法治化是推进依法治教、矫正失范权力、保障基本权利的要求.因此,高校学生管理规范的制定要遵循法律法规原则,要完善学生管理规范的制定程序,健全学生受教育权的法律救济制度.

| Abstract: | The lawsuits of students lodging complaints against universities happened one by one in recent years,which reflected the shortcomings of students management regulations.Certain content of the university regulations of students management goes against law of high level,the necessary procedure of making the university regulations of students management was lacked and the students' legal rights relief channels were not unblocked.Realizing the university regulations of students management in legality is necessary for promoting education in accordance with the law,correcting illegal rights as well as protecting basic rights.Therefore,the making of the university regulations of students management must abide by laws,rules and principles,its procedure and the legal relief rules of students' receiving education rights must be perfected. |
