论列宁的司法平等思想

作为马克思主义思想的继承者、社会主义的开创者,在领导苏俄革命和司法建设过程中,列宁阐发了一系列关于社会主义司法平等的思想和理念。列宁认为,要实现司法平等,就需要从制度上保证从同类人中选任审判员和陪审员;从法律上确认公民司法面前的平等资格;从司法程序上对当事人的诉讼权利予以平等保障;国家还要提供给当事人以平等的诉讼条件。

On Lenin's Thought about How to Realize the Judicial Equality

As the successor of Marxism and the inaugurator of the first socialist country in the world, Lenin elaborated a series of thoughts and ideals about the judicial equality of socialist country in the process of leading the revolution and the judicial construction of the former Soviet Russia. He thought that we should ensure to empanel the judge and the jury from people, to affirm the equal qualification of all citizens before law, to safeguard equally the procedural rights of participants in proceedings according to law, and to offer equal lawsuit condition to the parties.
