关于我国婚前财产协议的立法完善

基于尊重婚姻当事人契约自由的理念,不少国家的法律支持婚前财产协议。而我国现行婚姻法在支持婚前财产协议的同时缺少明确的必要的规制,导致实践中当事人婚前财产协议的内容五花八门,司法裁判也各不相同。为了保护婚姻当事人的权益以及善意第三人的交易安全,我国婚姻法应明确设定婚前财产协议的原则及其衡平规则,例如规定以婚姻自由为对价的婚前财产协议无效等,应增设兼顾财产静态价值与动态增值的夫妻财产制类型,应增加管理权、清算程序作为财产约定的内容,应明确规定婚前财产协议生效的时间以及公示要求、变更以及撤销程序。

On Legislative Perfection of Prenuptial Agreement in Our Country

Many country support prenuptial agreement in their law on the basis of the concept of contract right. However prenuptial agreements in our law have a lack of explicit and requisite limitation, thus miscellaneous pre- nuptial agreements and diverse judicial practice in our life. In order to protect the right of the parties of marriage and the transaction security of the bona rides third party, in our marriage law, the legal principles and their equity are necessary to set, for example, the prenuptial agreement make someone ＇ s marital autonomy as a consideration is invalid： some additional provisions is necessary to set, such as the type of marital property system consider both static value and dynamic value in property, management and liquidation on property, time of the agreement in force, publicity requirement, change and revocation procedures on the agreement.
