| 摘 要： | 商业贿赂犯罪行为人均具有直接故意的主观罪过,同时还具有明确的犯罪目的。每一商业贿赂行为人明知自己的行为会破坏公平竞争的市场经济秩序,却积极追求并希望这种犯罪结果的发生。商业行贿犯罪中行为人的目的是在商业活动中获取不正当利益,商业受贿犯罪中行为人的目的是在商业活动中用职务换取财物。

| Abstract: | The subjects on crimes of commercial bribery have directly and clearly criminal intent.All the subjects on crimes of commercial bribery know that their acts entail harmful consequences to the market economic order but they wish such consequences to occur.The bribers on crimes of commercial bribery aim to derive illegal profits from the commercial activities,and the bribees aim to get money and valnables by utilizing their positions. |
