法治进程中的程序法制及其现代化

西方法治的历史就是奉行程序法制的历史。中国传统社会重实体轻程序，现行的程序法制仍带有国家职权主义色彩。建构中国社会主义法治国家，首先必须加强程序法制建设，建立主体平等、过程公开、决策自治的现代程序制度，发挥程序法制和实体法制的双轨合力，加速中国法治化的进程。

Law System of Procedure and Its Modernization in Course of Rule of Law

In the West, the history of “rule of law” is right the history of law system of procedure. In the traditional society of China, the substantive law is superior to the law of procedure, and today's law system of procedure contains state authority. Building up socialist rule-of-law state means setting up the law of self-rule procedure, including equality of parties, opening of order, self-government of decision etc, in order to give double-track play to the substantive and procedural law in the course of the rule of law.
