| 摘 要： | 从时代精神的演进及其与社会实践的互动的角度切入,梳理战国时代与启蒙时期的历史发展线索,把握中西刑法精神的演进及其历史生成条件,发掘战国与启蒙时代刑法思想的异同,探寻战国与启蒙时代刑法思想异同及其历史、文化根源,以求对中外刑法思想、刑法传统与刑法现代化问题的深刻体认。
