| 摘 要： | 通过适用民事习惯法保护法益,是民事习惯法作为法律渊源发生作用的一个结果。习惯属于一种＂习惯权利＂,大多数的＂习惯权利＂都会随着立法程序的确认转化为＂法定权利＂,而还有部分的＂习惯权利＂没有转化。此种剩余部分的＂习惯权利＂中的部分又会在实践中发挥其习惯的调节功能,从而表现为法律所保护的权利之外的法益。
