| 摘 要： | 本文通过分析历史上东西方社会对人性的不同认知,解读东西方社会对治国模式的不同制度设计。西方社会基于＂人性恶＂的认知在治理国家的策略上采取＂法治＂的制度安排,而东方社会基于＂人性善＂的认知在治理国家的策略上采取了＂人治＂的治国安排。本文通过论证＂法治＂与＂人治＂的不同渊源得出结论：作为一种治国方略,＂法治＂和＂人治＂是殊途同归的制度设计,然而在当代社会＂,法治＂是更具理性与稳定性的制度安排,是和谐、繁荣的必由之路。
