中非追缴腐败犯罪违法所得的国际司法协助

随着经济全球化以及中非政治、经济交往的增加,腐败犯罪违法所得在中非之间的跨境转移也必然呈现上升态势,因此,中非之间在追缴腐败犯罪违法所得领域的合作变得非常迫切。虽然中非在此领域的合作还刚刚开始,但是《联合国反腐败公约》、《非洲联盟关于预防和打击腐败公约》及《中华人民共和国对非政策》已为中非打击腐败、追缴腐败犯罪违法所得合作确立了依据。中非之间在此领域的合作要遵循主权原则,同时要在主权的行使方面保持适度的灵活性,在双层合作的框架下推动在此领域内双边或多边条约的缔结。
