| 摘 要： | 本文通过对票据抗辩权的法理基础进行剖析,揭示了票据抗辩权存在的应然性与合理性。首先,票据抗辩权乃公平原则之体现,通过赋予票据债务人票据抗辩权以实现票据当事人的地位平等保护,从而实现票据当事人的利益平衡;其次,票据抗辩权乃正义对安全校正之载体;复次,票据抗辩权乃票据流通与交易安全平衡之手段;最后,票据抗辩权实现了票据的经济效益,票据抗辩权的设置对票据这种资源的配置更有效率,实现了法的经济价值——效益。
