| 摘 要： | 在我国,由于受传统继承习俗的影响,被继承人死后有数个继承人的,继承人一般并不立即要求分配遗产,往往一段时间后才进行分割。我国《继承法》并未规定继承人在这一期间的法律地位。对遗产分割前遗产的归属及各继承人的法律关系等问题做出明确规定,有利于解决共同继承纠纷,有利于保护继承人和债权人的合法权益,促进社会稳定发展。

| Abstract: | In China,if there are some successors,the successors do not immediately request the assignment of inheritance generally because of influence of the traditional inheritance custom,and often carry on the division after long time.But Chinese "inheritance law" has not stipulated inheritor's legal status of this period.It can help to solve inherit the dispute together,to protect the legitimate rights and interests of inheritor and creditor,and to bring about an advance in social stability that make clear regulation in questions such as the ownership of the legacy and every inheritor's legal relation,etc.before cutting apart to the legacy. |
