| 摘 要： | 19世纪90年代以来,中国近代司法理论和制度开始构建。中国近代司法的构建是在民族国家观念兴起的基础上才得以展开的。具体而言,国家主权观念的形成为中国近代司法产生提供了外在条件,国家正当性理念的提出则为中国近代司法产生提供了内在条件。

| Abstract: | Since 1890's,the modern Chinese judicial theory and system had been constructed.The modern Chinese judicature was based on the appearance of the concept of nation.That is to say,the idea of sovereignty was the external condition to bring about the modern Chinese judicature,and the sense of the justification of government was the internal premise to bring about its appearance. |
