| 摘 要： | 医疗保险是我国社会保障制度中的重要组成部分,定点医疗保险服务协议是医疗保险制度得以实施的重要途径。但是理论和实务界对协议的性质一直都争论不断,从协议的实施主体、内容以及目的来看,该协议的性质应当为行政合同。

| Abstract: | Health-care occupies a significant part of social security management in China,designated health-care service agreement being an important approach to implement the basic medical insurance policy.However,argument concerning the nature of service agreement always exists between theorists and practitioners.The author holds that it is administrative contract in accordance with the subject of implementation,content and object. |
