"农民工"社会保障平等权的法律思考

在我国城市化进程中,具有农民身份的农民工在同等条件下不能享受与城镇职工平等的社会保障权,这源于城乡二元结构下一系列制度造就的城市与农村的分隔、居民与农民的不平等。在当下中国,国家尊重和保障人权、建设法治国家已成为时代主旋律,政府亦当采取切实有效的措施,实现农民工的平等社会保障权。

Reflections on Law of Equal Right of the Social Guarantee for the "Peasant-labour"

In the process of urbanization in our country,the peasant-labour with the identification of peasants cannot,in the same conditions,enjoy equal social guarantee as the workers from cities and towns do.The inequality has been produced by a serial of systems under dual structure of the city and countryside,which cause the separation of the city from the countryside and inequality between the urban inhabitants and rural peasants.At present in China,the whole nation respect and protect human rights,and to construct a country with laws has become the main tune of the age,so the government should take effective measures in order to realizing the equal social guarantee for the peasant-labour.
