| 摘 要： | 效率违约作为经济分析法学的代表观点之一,突破了传统违约理论的范畴。实际履行原则的限制使用和合理预见规则的适用,使效率违约成为可能。效率违约理论对效益价值的青睐有一定的正当性。

| Abstract: | The efficient breach of contract has been one of the representive views of economic analysis of law,exceeding the traditional theory of breach of contract.Owing to the limitation of the specific performance and the rule of reasonable prevision,the efficient breach of contract is inevitably possible.This theory has a legitimate reason for the favor of the beneficial value of law. |
