| 摘 要： | 韩非和亚里士多德在设计官吏选拔制度上存在"相马"模式与"赛马"模式的差异,"相马"模式体现人治特征,"赛马"模式体现法治特征,两种制度模式同源异流,即有着共同的法哲学基础却呈现不同的走向."相马"模式神秘面纱背后隐藏的是阴暗诡诈,"赛马"模式则渗透着客观、公正和透明的奥林匹克精神.

| Abstract: | There are many differences between the"horse identification"model and the"horse race"model when Hanfei and Aristotle design"official selection and appointment system". The"horse identification"model is characteristic of rule by men, and the"horse race"model is characteristic of rule of law. Though they originate in a somewhat similar way, these two system models flow in different streams, i.e. they share in common some basis for legal philosophy but take on different trends. Behind the mysterious veil of the"horse identification"model are shrouded countless gloomy conspiracies. On the contrary, in the"horse race"model is permeated the Olympic spirit of impersonality, justice and openness |
