| 摘 要： | 传统的刑事诉讼理念已不再适应现代法治社会的需要.正因为传统理念的糟粕要被淘汰,现代社会刑事诉讼理念应坚持几种基本价值取向:惩罚犯罪与保障人权相统一,公正与效率,控审分离、控辩平等对抗与审判中立,客观真实与法律真实相结合以及开放与自治.

| Abstract: | The traditional ideas of criminal procedure could no longer meet the needs of modem society governed by law. Some of their principles have to be abandoned, while some basic values of the modem criminal procedure ideas should be advocated, including the unity of the punishment of crime and the protection of human fights, justice and efficiency, separation of prosecution from trial, equal confrontation between prosecution and defence, trial neutrality, unity of legal truth and objective truth, as well as legal openness and autonomy. |
