浅论中国宪法的司法化进程

宪法司法化是宪政的基石,中国宪法的司法化无成例可考,通过个案分析的方式,对我国宪法司法化的实践进行了理论剖析;通过比较分析的方法,概括了外国违宪制度的相关类型和发展趋势,据此提出从宪法引用、违宪审查两个方面均应司法化的观点。分析了中国宪法司法化在法理上、制度上的障碍,提出了“法规审查备案室”到“违宪审查委员会”再到“宪法法院”的适合中国国情的中国宪法司法化的必经之路。

Study on the Jurisdiction of Constitution Course of Constitutional Law in China

The constitution judicature is the cornerstone of constitutional administration,but the Chinese constitution judicature does not have the precedent to be possible to test.Through the way of document analysis,the article has carried out the theory analysis on the constitution judicature practice in our country;through the comparative analysis method,the overseas violation of the constitution system type and the development tendency are summarized,and according to the above,it is proposed that both of two aspects of the constitution quotation and the violation of the constitution should be under judicature.Through analyzing the barrier in the legal principle theory of law and the system in the Chinese constitution judicature,from "the laws and regulations examination file room" "the violation of the constitution jury" to "the constitution court",the unavoidable Chinese constitution judicature road which suits the Chinese national condition which must be proposed.
