| 摘 要： | 反垄断法的立法价值,是一个有很大争议的问题,它体现了公平与效率的矛盾。在世界各国,促进经济效率仍然是反垄断法的首要目标,但不是唯一目标,还应关注社会的公平和正义。反垄断法中的公平、正义,更多的是指对消费者权益的保护和对中小企业发展的保护。对消费者和中小企业的关注,可以对促进经济效率构成一种限制与修正。

| Abstract: | The value of the antitrust law which shows conflict between equity and efficiency is a controversial issue.The improvement of economic efficiency is still the main goal of the antitrust law and attention should be paid to equity and justice of society.Equity and justice of the antitrust law mean protecting the right of consumers and the development of small and medium-sized enterprises.Attention paid to consumers and small and medium-sized enterprises can produce a limitation and adjustment to improvement of economic efficiency. |
