| 摘 要： | 从法律的视角，深刻论述了教育惩戒的正当性，明确指出了我们为什么需要教育惩戒以及教育惩戒的存在在何种程度上合乎理性，并具体提出了教育惩戒的实施限制。这无论是对于我们在新的历史条件下确立现代教育观念，深化教学管理体制改革，还是对于培养社会主义的“四有”新人，都具有重要的理论价值和现实意义。

| Abstract: | In view of law, the article discusses profoundly the justness of educational punishment, points out explicitly the necessity of educational punishment and the rationality of its existence, and puts forward the limitationof conducting educational punishment. It is of important theoretic value and realistic significance for the establishment of the modern educational conceptions, for the deepening of the reform in educational system and management in new historical conditions, as well as for the cultivation of the new virtuous students under socialism. |
