浅议物流环境民事责任之完善

随着现代物流的发展,物流环境污染损害赔偿案件不断发生,作为一种特殊的侵权,其有别于传统的民事责任制度。通过分析现有民事责任制度不适合物流环境赔偿之处,借鉴国外一系列新的民事责任因果关系学说,提出明确规定推定因果关系、明确规定举证责任倒置、扩大环境民事侵权范围、增加物流环境民事责任社会化因素等物流环境民事责任立法构成要件方面完善,旨在完善环境民事责任制度。
