| 摘 要： | 朱熹"以严为本"的司法思想主要体现在适用刑罚时反对重罪轻刑,主张罚当其罪;在诉讼活动中应贯彻"以严为本而以宽济之"的慎刑原则,防止滥刑;在诉讼程序上要求"明谨用刑而不敢留狱",保证审判质量和效率;在法官职业道德上追求公正诉讼,严防偏私。朱熹"以严为本"的司法思想对当今构建和谐社会提供了有益的历史借鉴。

| Abstract: | ZHU Xi's strict judicial thinking was manifested mainly in the application of penalties against felony light.He persisted in suitable punishment and believed that the pity punishment principles of strict with tolerance should be implemented in the proceedings to prevent indiscriminate torture;the cautiousness and efficiency were needed in the proceedings to ensure the quality and efficiency of adjudication,and judges' ethics proceedings against selfishness was necessary in the pursuit of justice.Legal system is an important carrier to achieve social justice.Legal system dominates a just and humane is a powerful protection for the harmonious society.ZHU Xi's strict judicial thinking provides a valuable historic resources for harmonious society. |
