现代法治的要义在于建立一个自由而有序的和谐社会,实现国家的有效治理。作为一种理想的社会状态,法治的生成不仅需要有良好而完备的法制,而且还需要相应的政治、经济、文化和社会条件作为基础。从形式法治到实质法治,必然是一个持续、渐进的动态过程,是多种生成机制综合作用的结果。世界法治国家法治实践的历史表明,文化驱动机制、利益协调机制、权利救济机制和权力监控机制对法治的生成具有至关重要的作用。

Formation Mechanisms of Modern Rule of Law

The modern rule of law lies in setting up a free and orderly harmonious society and realizing the effective governance of the country.As a kind of ideal social state,the formation of rule of law not only needs good and complete legal system,but also needs corresponding political,economic,cultural,and social condition as the foundation.It must be a lasting,progressive and dynamic course and the result of all the mechanisms from rule of law in form to that in essence.The history of rule of law of the world countries shows:driving mechanism of culture,coordinative mechanism of interests,remedy mechanism of rights,controlling mechanism of power have essential functions in forming rule of law.
