论我国城镇住房保障制度的发展与完善——以基本权利为视角

从基本权利的角度来看,新中国成立后,我国城镇住房保障制度大致经历了福利分房阶段和住房改革阶段。在现实中,我国城镇住房保障制度有诸多不足,如基本权利设定不足、改革指导思想不足、政府职能定位不足、覆盖人群不足等。从人权需要和宪政发展来看,我们应该从以下几个方面进行改进：将居住作为基本权利进行宪法规定,同时明确政府的住房职责,厘清政府和市场的分工等。

On the System of China's Urban Housing Security--From the Perspective of the Basic Rights

In terms of basic rights, since the founding of PRC, China＇s urban housing security system has roughly developed in two stages： the welfare housing distribution stage and the housing reform stage. In reality, China＇s urban housing security system has many inadequacies, such as inadequate basic rights guarantee, inadequate ideas guiding reform, inadequately established governmental functions regarding it, and insufficient coverage concerning beneficiaries. For the sake of the human rights need and the constitutional government development, improvement should be made in the following aspects： regarding housing as a fundamental right as laid down in the Constitution, establishing governmental duties regarding housing, making a clear distinction between the government and the marketplace in terms of their separate roles and functions.
