| 摘 要： | 大陆死刑的法典立法模式要优于台湾地区死刑的综合立法模式。大陆死刑适用条件比台湾地区具体复杂,而台湾地区对80周岁以上老年人不适用死刑。大陆死刑适用范围远远宽于台湾地区死刑适用范围。大陆刑法中存在绝对死刑,而台湾地区刑法则没有绝对死刑。通过比较得出对我国大陆死刑改革的启示是：刑法修正案是死刑立法改革的良好形式;要探讨死刑适用对象的年龄上限;在立法上缩减死刑的适用范围;取消刑法中的绝对死刑。

| Abstract: | The code mode of death penalty in Mainland is better than the synthetic mode of death penalty in Taiwan.The condition of the death penalty in Mainland is more specific and complicated than that of Taiwan. However,the death penalty in Taiwan is not applicable to the old people aged 80 or over 80.The scope of application of death penalty in Mainland is broader than that in Taiwan.There are several kinds of mandatory death penalty in Mainland,whereas not in Taiwan.By above comparison,this paper concludes the following enlightenments;amendment of criminal law is a good form of legislative reform of death penalty;it is vital to explore the age maximum of application of the death penalty;it is also reasonable to reduce the scope of the death penalty and to cancel mandatory death penalty. |
