| 摘 要： | 任何一项证据制度的确立,其背后必然具有一定的理论来支撑。司法认知作为一项证据制度,其设立和运作同样有一定的理论支撑点。建立司法认知的法理之维就是为了实现诉讼公平,消除不合理的费用和拖延,提高诉讼效率。
