摘    要:就业协议与劳动合同在法律依据、订立主体、签订时间、内容、发生纠纷的处理部门等方面存在不同.两者的冲突表现在就业协议中有关见习期、违约金的规定常与劳动合同中试用期的规定相互矛盾;另外,两者在福利待遇等具体内容的规定方面经常不一致.解决问题的根本办法是将就业协议与劳动合同合二为一.

Abstract:Law bases,signatory parties,time of signing,contents and departments of tackle disputes are different between employment agreement and labour contract.Conflicts between them lie on the reciprocal contradictory regulations between on learning time on the job and breach damages in employment agreement and probation in labour contract,and frequently varied regulations on some concrete contents such as welfare.The fundamental ways to resolve the conflicts is combine employment agreement and labour contract into one.
