| 摘 要： | 刑罚目的和刑罚的适用一直是我国刑法学界探讨和争论的主要问题,问题的焦点之一是刑罚的适用轻重能否达到刑罚惩罚的目的,本文就我国刑法规定的刑罚类型、以及适用轻重引用了刑法界各专家的观点,在总结吸收的基础上浅谈我国刑罚的适用轻重问题。
