专利权国际保护与欧洲统一专利权的区域性实践

专利自身的无形性是其寻求国际保护的内在动因。随着贸易全球化和世界经济一体化趋势的日渐明显,国家利益尤其是发达国家的利益成为专利权国际保护不断完善和发展的外在推动力。专利权国际保护主要依赖双边或多边条约,当然也包括统一专利权的区域性实践。以欧洲为视角,介绍欧洲专利一体化实践和欧亚专利保护体系的形成,并对欧洲统一专利权的区域性实践进行评析。

International protection of patent rights and regional practices of uniform patent rights in Europe

The invisibility of patent is the intrinsic factor for itself to seek international protection.Along with the trading globalization and the integrating of the world economy becoming more and more remarkable,the national interests,especially the interests of developed countries has turned into the external propelling force to improve the international protection of the patent rights. The international protection of the patent rights mainly depends on bilateral or multilateral treaties and indeed it also includes the regional practices of uniform patent rights.Taking Europe as the angle of view,the paper presented the practices of European integrating of the patent and the forming of the patent protection system between Europe and Asia and commented on the regional practices of uniform patent rights in Europe.
