| 摘 要： | 由于各种主客观方面的原因，我国在监狱立法和行刑实践方面存在着较大的“悖反”，立法中所规定的罪犯权利难以在实践中得以兑现，行刑实践中所奉行的依然是注重惩罚与剥夺的消极的个别预防理念。现阶段应当按照社会管理创新要求，总结我国行刑实践经验，从思想理念上创新监狱管理，注重犯罪人的本质与深层需要，以利于其更新改造和复归社会为旨归的积极的个别预防。
