基于公民权利理念的农民社会保障及“土地换社保”问题分析

社会保障是一项公民权利。农民社会保障缺乏是长期以来二元社会结构影响下形成的城乡保障体系分立的结果。“土地换社保”措施是在这一现实背景下，解决被征地农民的民生问题而采取的一项权宜之计，具有一定积极意义。但这一做法违背了社会保障权的权利主体平等性、义务主体特定性，侵犯了宪法赋予每个公民的平等的社会保障权，实际已背离社会保障的本意。
