社区矫正的概念及其性质新论

社区矫正的概念和性质问题,是决定能否对社区矫正工作进行正确定位和能否科学构建具有我国特色的新型犯罪矫正模式的基本问题。社区矫正是矫正机构将罪犯放在社区里进行矫正教育,在社会团体和民间组织以及社会志愿者的协助下,有效地利用社会资源矫正教育罪犯的新型矫正方式。社区矫正的性质并不是刑罚执行活动,而是对罪犯的管束保护或观察保护,具有限制人身自由的保安处分的性质。
