| 摘 要： | 非法行医罪是我国1997年修改刑法新增加的一个罪名。目前因为种种原因。我国非法行医的现象非常普遍，而且屡禁不止，严重破坏了正常的医疗管理秩序，及时有效的打击非法行医的犯罪活动成了当今社会关注的一个焦点，但在司法实践中对非法行医罪的认定等方面却存在着模糊认识。非法行医罪是指未取得医生资格的人非法行医，情节严重的行为；在非法行医罪的主体问题上存在争论，莫衷一是；非法行医罪和医疗事故罪、过失致人死亡罪、过失致人重伤罪以及诈骗罪之间存在区别。

| Abstract: | Practicing medicine of illegally is a newly added crime when the criminal is revised. Practicing illegally is very popular in our country for various reasons and the worse is that it can not be forbidden. The normal medical administrative order is disturbed and cracking down practicing medicine illegally effectively has become the focus of the society. The guilty of practicing medicine illegally can not be found very clearly. The definition of it is that the person who is not qualified for practicing medicine practice medicine illegally and the case is very serious. There are many disagreements on the issues of the many differences among practicing medicine illegally, the accidents main body of practicing medicine. There are in practicing medicine,causing sob to death, hurting others without intention and cheating. |
