| 摘 要： | 我国<继承法>第14条关于遗产酌分请求权的规定对于保护遗产酌分权人之权利的意义是应当肯定的,但此项规定过于笼统,无论是享有酌分权的主体,还是酌分权的构成要件,亦或酌分权的份额,都缺乏明确、具体的标准,因此建议在修改<继承法>时对扶养人、被扶养人这两种酌分权的构成要件及享有的权利应分别予以详细规定,才能真正发挥此条款的实际作用,并避免实践中不公平现象的发生.

| Abstract: | In The Succession Law of the People's Republic of China,Clause 14 provides the right of claiming for the right to inheritance and the protection of the right of the successors; however, the statement is not so inclusive in detail. Definite and specific standards are needed for the following elements: the persons who have the right to inheritance of the decedent, the components of the claim, and quantity of the distribution of the legacy. |
