| 摘 要： | 诚实信用原则在刑事辩护中的运用为人们所忽视。在我国刑事辩护制度中确立诚信原则,符合律师承担真实义务理论以及律师职业伦理的要求,有利于保障被追诉者的合法权利和利益。立法应进一步明确辩护律师向法庭承担真实义务和保密义务的范围、律师勤勉义务及无效辩护的法律责任。

| Abstract: | The honesty principle in criminal plead system has been neglected in practice.In the criminal plead system,this principle accords with the need of occupational ethics of lawyer and the theory of true obligation.It benefits the protection of the legal right and interest of the accused.Legislation,therefore,ought to further make clear the scope of the attorney's obligation to provide sound evidence and to maintain secrecy,and the lawyer's legal liability of invalid plead. |
