哈耶克视野中的预期与法律

对于哈耶克来讲,在预期与法律的关联之中,存在着法律与预期之间的冲突和不确定性,进而可能导致对预期与法律之间相互关系的调整、修正,或在返回预期本身之内的努力中重新理解和更改法律,这就使得预期成为了法律的根据。要完成这一"根据",就需有赖于在"法律人",尤其是在法官具体实现那些置身于行动秩序之间的个人预期的保护当中,来推进到预期对于法律产生修正效应的问题。当然,法律实现预期的方式存在着某种限度。
