| 摘 要： | 法律作为调节社会的手段,需要敏锐的感知、反映现实生活中具体矛盾的实质与变化方向,而非主观的强迫人们接受顽固不化的规则。这一点在国际私法,尤其是国际货物运输法领域体现得尤为明显。尽管目前传统的海运强国无一例外地拒绝《汉堡规则》,但这并不意味着这一星星之火般的公约在未来不会有燎原之势,并彻底颠覆《海牙—维斯比规则》而成为国际航运业的准据法。

| Abstract: | As a measure to regulate society, laws should respond to the substance and trends of specified contractions in real life rather than force us to accept stubborn rules. International cargo transport law is a good example to prove this case. Though all the traditional seaborne powers denied the Hamburg Rules, it doesn＇ t mean that the rules wouldn＇ t overturn Visby Rules and occupy the international shipping laws. |
