| 摘 要： | 善意取得制度作为一项古老而重要的民法制度,其构成要件已日臻完善.然而随着社会经济的不断发展,特别是在我国即将制定<物权法>之际,善意取得制度仍有许多值得检讨之处.善意取得制度的法律要件包括前主、受让人和标的物三大方面,但这三大要件都有了新的发展.不动产、动产质权与抵押权也应适用善意取得制度,我国<担保法>与善意取得制度有冲突之处.

| Abstract: | This paper discusses the good faith obtaining system. As one old and important part of civil law, its components have already become complete. But with the development of social economy, the three components of this system, including previous owner, buyer and object, have changed. They should also be applicable to real estate and moveable property mortagage. Based on our study, the author thinks there are conflicts between the good faith obtaining system and the guaranteeing law. |
