近代北京商铺的铺底与铺底权

在北京商铺的租赁、倒卖过程中,先有铺底,后有铺底权,铺底权依着于铺底而存在。民国以前,铺底与铺底权皆为北京民间商业习惯,并未得到清政府的承认;民国后才逐渐被政府承认为一种权利,但一直亦未被列入民法典。本文主要就铺底与铺底权的概念、分类、铺底用钱占商铺总投资的比例、积极作用及负面影响等方面进行论述,以期为商业承租人长期经营所形成之客户资源群的维护及商家经营稳定性问题提供有益借鉴。
