| 摘 要： | 历朝历代的《刑法志》都是研究中国法制史的基本史料,也是中国历代官修正史的重要篇章。《刑法志》对各个朝代立法、司法、法制建设及法律思想的记载和阐释,不啻为各封建王朝关于法的理论和历史的官方史料,其观点获得封建统治集团的认可、采用,并作为他们施政和实行法制的指导。可是学界对《刑法志》的研究很少涉及到《宋史·刑法志》。根据《宋史·刑法志》的记载,宋代强化了中央集权的立法思想,记述了宋代刑事立法的主要内容,反映出了宋代独具特色的刑事法律制度。

| Abstract: | "The Chapters of Criminal Law",as important amendments of official history in terms of legislation, judicature,legal system and legal thoughts during Chinese feudal dynasties,are foundmental materials for researching Chinese legal history.These important chapters were amended by officials during Chinese past dynasties.But the research and interpretation on"The Chapters of Criminal Law"of the Song Dynasty is rare. In fact,this document indicates the strengthened legislative ideas of centralization,main contents of criminal legislation,and unique characteristics of the criminal law in Song Dynasty. |
