| 摘 要： | 我国《公务员法》规定了公务员对上级明显违法的决定或者命令具有拒绝执行的权利,这无疑是我国建设法治政府征程上的一个里程碑,对我国公务员制度的创新具有重大意义。但这一权利的行使在现实中存在诸多问题,需要对"明显违法"、行使程序及该权利的保护和救济作出认真分析,并完善相关的法律制度。

| Abstract: | The Civil Servant Law of PRC stipulates that the civil servants have the right to reject to execute an illegal order made by higher authorities.This has been a milestone to build the government of ruling by law,and it has great importance to our country's civil servant syestem's innovation.But there exists a lot of problems on its practice in reality.To fulfill the right,proposals are suggested to analyse"obvious illegality",exercise procedure,the protection and relief,and to perfect revelent legal system. |
