从企业产权出售看国家对国有企业的权利本质

目前 ,我国正在对国有中小型企业的放开搞活进行各种改革的尝试。在对中小型国有企业的产权出售实践中 ,各级地方政府都将产权出售完全变为企业出售 ,以致出现了许多随时可能发生的权利纠纷或权利义务不明的永久性隐患。笔者认为 ,所有矛盾的焦点在于国家对国有企业的权利性质没有准确界定。只有坚持国家对国有企业的权利本质是股权 ,产权交易才可能按合法的形式来进行。

The Nature of the Ownership of the State-Owned Enterprises by the State Seen from the Sales of the Enterprise Rights

Our country is currently making attempts to rejuvenate the medium and small sized state owned enterprises by reforms in one way or another.In practice,the local governments at different level make a sale of the enterprise itself,instead of selling the rights of interest.In such a case,the haunting problems of right disputes of unclear rights and obligations may arise at any time.The author believes that the lack of a correct definition on the nature of ownership of the state owned enterprises by the state is the key point of the problems.Only by insisting what the state owns in the enterprise is the interest can the transactions be made in the legal forms.
