关于设立司法官地区回避制度的思考

根据我国法官法、检察官法、人民法院组织法、人民检察院组织法和三大诉讼法的规定,我国现行的司法官(指法官、检察官,下同)回避制度有两种,即任职回避和公务回避,而地区回避尚未涉及。要使司法官处于超脱的地位,减少违法办案的可能性,仅仅靠司法官的任职回避和公务回避制度还是不够的,应考虑建立司法官地区回避制度。

On Judicial Official Area Evasion System

According to stipulation of the judge law,the public prosecutor law,the people's court constitutive law,the people's procuratorate constitutive law and the three big procedural law of our country,there are two types of judicial official(refers to judge,public prosecutor,similarly hereinafter) evasion at present in our country,which are assignment evasion and official business evasion.The area evasion has not yet been prescribed.In order to put judicial official at the impersonality position,to reduce the possibility of illegal handling a case,judicial official's assignment evasion and official business evasion system is insufficient.The judicial official area evasion system should be established.
