无居民海岛物权制度探析

随着我国海洋经济的发展,无居民海岛作为一类具有综合价值的自然资源越来越为社会所重视。无居民海岛作为—个专门、独立的资源类型,其物权既不同于传统民法上不动产物权也不同于其他自然资源物权,必须从明确无居民海岛的归属关系和使用关系人手,构建无居民海岛物权体系;通过修订《物权法》和对无居民海岛进行特别立法完善无居民海岛物权制度,以提高其使用效率和效益,实现资源的合理配置。

On Property System of Uninhabited Islands

With the development of China＇s marine economy,the uninhabited island,a natural resource with comprehensive value,is drawing increasing social attention.As a special and independent kind of natural resource,the law of the property of uninhabited island should be different from immovable estate stipulated by traditional civil law or other property of natural resources.The property system of uninhabited islands must be constructed from the point of defining the attributive relationship and the utilization. For the sake of reasonable resource allocation,the government should revise the property law,legislate its special law,and perfect the property system of uninhabited island to improve the efficiency and effectiveness.
