| 摘 要： | 我国学术界关于高校与大学生法律关系的研究在民事法律关系、行政法律关系、综合性的法律关系、教育法律关系、特别权力关系、具有特别权力因素的公法关系以及契约关系等性质判定上产生争鸣。高校与大学生是有角色区分的,不同的角色具有不同的法律定位,从而形成不同的法律关系。

| Abstract: | The legal relationship between institutions of higher learning and college students has become a topic of general interest.This paper offers the comments on the legal relationship between institutions of higher learning and college students from the view of academic circles.Studies on the legal relationship between higher institutions and college students are generally the following:civil affair legal relationship,administrative legal relationship,all-round legal relationship,educational legal relationship,special rights relationship,public law relationship with elements of special rights and contract relationship. |
