| 摘 要： | 滥用职权罪是1997年《中华人民共和国刑法》规定的一种危害十分严重的渎职罪。由于该法条规定的过于简略,该罪在理论和实践中引起较多争议。本文提出了滥用职权罪的概念及认定问题,重点分析了滥用职权罪与玩忽职守罪和特定主体的滥用职权罪的区别,讨论了滥用职权罪处罚中的几个难点问题,最后提出了完善滥用职权罪的立法建议。

| Abstract: | The crime of abusing one's power is a kind of malfeasance crime that endanger very serious stipulated by the"the Criminal Law of the People's Republic of China"issued in1997.The crime of abusing one'S power caused more dis-putes in the practice and the theory because the stipulation of the law's article is too simple.After putting forward the guit-ly concept and the question about the crime asserting,This text analysed the differences among the crime of abusing one's power,crime of neglecting one's duties and the specific three-dimensional abusing one's power guilty especially,discussed several difficult point issues of abuse one's power crime punishment and put foward the guilty legislative suggestion of abusing one's power finally. |
