| 摘 要： | 我国农民拥有的法定财产权主要包括宅基地使用权、土地承包经营权、土地征收补偿权和专业合作社中的财产权.但规范这些权利的法律法规还不够完善,要从宅基地使用权、土地承包经营权、土地征收和农民专业合作社等方面健全法律制度和管理制度,从而达到保护农民财产权利、发展农村经济的目标,处理好国家、集体和农民之间的利益关系,缩小城乡差距,实现社会公平正义.

| Abstract: | Legal property rights that farmers in China have mainly include the homestead right of use, the right of the con- tracted management of land, land expropriation compensation right and the property right of professional cooperatives, but the specification of these fights is still not perfect. Perfecting legal system and management system need start from 4 aspects： the homestead right of use, the contracted management of land, land expropriation and professional farmers cooperatives, in order to reach to the goal of protecting the property rights of farmers, developing rural economy, dealing with the interest relationship be- tween countries, the collective and peasants, narrowing the gap between urban and countryside and realizing~ social fairness and justice. |
