地方政府行政决策裁量权的公法控制

地方政府的行政决策对于中央政令的落实以及辖区公众的利益实现具有重要作用,但在近年来却屡受诟病,笔者以委托代理关系为工具,将行政决策权行使中出现的裁量偏离作为考查重点,分析了决策过程的主要考量与行为逻辑,在此基础上提出了公法对此的应对之策。

Structure and Policy:The Public Law Limitation on Administrative Discretion of Local Governments

Administrative decisions of local governments are much criticized recently although their significance to the public.This paper selects principal-agent theory as a tool,explores the deviation of the administrative decisions of the administrative officials,analyzes the main factors and logics of the decision-making process,and gives some suggestions in terms of public law.
