| 摘 要： | 从抚慰补偿受害人的角度对精神损害赔偿数额评定,这一思路已为世界上许多国家的立法所采纳。然而由此得出的关于精神损害赔偿数额的评定在司法实务中难以具体操作。从社会利益的角度出发,运用经济分析的方式对该问题的研究思路进行新的思考,或许对现有理论起补充作用。

| Abstract: | It is the practice of most countries to assess damages for spiritual harm on the basis of compensating and appeasing victims.However,the assessment from this method proves to be unsatisfactory in judicial practice.Form the point of social welfare,the author employs the economic analysis to provide a new perspective of this issue in order to enrich the existing theories. |
